CASE #1: License Loss Saved & Reduced Demerit Points
SITUATION: A young guy on the Gold Coast received two tickets and three demerits point which was enough to lose his license.
He lived in the Hinterland and commuted to Brisbane for work each day. If he lost his license he would lose his job.
The first ticket was for running a red light. The police that pulled him over was an unmarked car directly behind him when he went through a red light.
The police officer also ticketed him for a defective vehicle, because there was oil leaking on to the MacPherson struts.
We argued in that the young driver drove through the stop sign because the police car was close behind him. He was concerned that the police car would crash into the back of his car if he stopped.
On the ticket for defective vehicle I, as an ex-policeman, challenged this by getting the son to take the car to a mechanic to get a full report on the defect. The mechanic came back proving that just because there was oil on the struct did not amount to it being defective.
RESULT: The license was saved and the 6 demerit points were reduced to 1 demerit point.
CASE #2: License Saved
SITUATION: A young guy was charged with Racing another vehicle. We successfully argued that they two drivers were ‘Pacing’ (Speeding Fine) not ‘Racing’ (Loss of License).
RESULT: The license was saved and instead a speeding fine was issued.
